Homeowners and Gas Drilling Leases. by Elizabeth Radow. NYSBA Journal nov-dec2011.indd

Great article by Beth Radow –

In some Texas towns, the gas well setback is 1000 feet from a house, so mortgages/ homeowners liability less of an issue
In NYS, the setback of a gas well from a house is 100 feet = GEIS 17 A. 1. B. 1. b. = which would put any mortgage into default.
That plus NYS egregious CI law and a NY mortgage covenant could trip.
As evidence of risk increases, the mortgage and insurance guidelines will change
Meaning the lender’s mortgage /insurance setbacks will increase for houses on water wells in particular.
As gas wells age, they leak on the outside of the outermost casing. This introduces methane into groundwater. Which pollutes wells.
Not much of a problem in Texas, New Mexico or Colorado = no ground water wells.  In NY, a problem.
So mortgage / insurance guideline/ covenants are apt  to become more stringent for NY rural residences on water wells. ]

Would not let this go unremarked  . . . .http://www.sourcewatch.org/index.php?title=DSGEIS_Responses

Description: Drilling and extraction of natural gas from the Marcellus Shale in Pennsylvania is creating opportunities in the Commonwealth, but it also is creating challenges for municipal officials. The drilling taking place in the Marcellus Shale will have an impact on municipalities throughout PA for decades. Careful and innovative planning is needed in all regions to reap the long term benefits for our citizens and communities. Experience in other states suggests that local officials need to be ready to manage the secondary impacts of drilling, which begins with a clear understanding of what is happening (or could happen) in your community, It is vital that governments think and work proactively about these impacts, rather than simply waiting for them to happen. This evening workshop will encourage attendees to recognize what tools they may already have enacted and how those tools can be applied to manage secondary impacts of gas drilling in the Marcellus Shale. The workshop will provide examples of tools to manage the impacts of gas drilling in their region, including community visioning programs, county and multi-community collaboration projects, state and federal agency support, and conflict/dispute resolutions. CDs of comprehensive plans, floodplain management ordinances, and the PA Wilds Design Guide will be distributed in the class.

Instructors will facilitate work groups to develop coordinated actions to take practical steps to deal with the varied impacts of natural gas development. Each instructor brings a wealth of practical experience that will inform attendees about what works and how to organize collaborative efforts between agencies and municipalities and their county planning agency.

Outline: During this workshop, instructors will engage attendees in discussion regarding the following subject areas:
Understanding what’s happening in your community
-Population change/development driven issues
-Coping with increased government expenditures
-Planning and zoning as a tool for effective community change management
-Industrial type change in rural areas
-Subdivision and land development ordinances
-Zoning ordinances and zoning parterships
–Floodplain and stormwater management tools
–Water and sewer systems
-Comprehensive, long-range planning

Tools in the Toolbox for Municipal Officials
-Community Visioning
-Academic Resources

On Tuesday, November 8, join Environmental Advocates of New York’s Water & Natural Resources Program Director, Katherine Nadeau, and Citizens Campaign for the Environment’s Legislative & Policy Director, Sarah Eckel, for a lunchtime webinar that will reveal the details behind New York State’s half-baked plans to move ahead with dirty gas drilling by means of high volume hydraulic fracturing or “fracking.”

We’ll give you the facts you need to know what is (and what isn’t) in the state’s plans and what you can do right now to weigh in on this critical issue and speak up for what’s best for our communities and our water.

Pollster Steve Greenberg will be here with details from the latest Siena Research Institute Poll.

Southern Tier Assemblywoman Donna Lupardo (D) will discuss two issues related to the recent flooding in her district: Updating the flood plain maps as well as her package of legislation aimed at exempting emergency expenditures by school districts from the state’s new 2% property tax.

And Hudson Valley State Senator Greg Ball (R) wants Governor Cuomo to tour regions in Pennsylvania badly impacted by gas drilling; plus, he’s pushing legislation called the Property Owner’s Bill of Rights that will create new standards for safe hydrofracking in New York.
