Fracking fight could be headed to court.
Kurkowski mad a similar threat to folks in Middlefield a while back. Michelle Kennedy offered this in response to his argument — “The court in Frew Run upheld the Town of Carroll’s decision to zone out mining based on the finding that the town of Carroll’s zoning ordinance was not a law relating to the extractive mining industry.” she said. Instead, the court found the zoning law regulated land use generally and, therefore, was not preempted by state regulations for a particular industry.
